Constitution Day and its relevance to the Citizens

The Constitution of India came into force on 26 January 1950 but actually it was the day of 26 November 1949 that the Constitution of India was adopted by the Constituent Assembly. Thus every year 26 November is celebrated as the Constitution Day or Law Day.

The Official name given to this day is "Samvidhan Divas". One of our forefathers Dr. B. R. Ambedkar played an instrumental role in the formation of Constitution of India and thus he is often hailed as the architect of the Constitution of India. In India Constitution is the Supreme Law which lays down procedure, policies, fundamental principles and powers, and functions of the Government of India.

The preface of the Constitution of India is termed as Preamble. It represents the source of the Constitution i.e the people of India. That is why it is often said that the Government is " of the people, by the people, and for the people. Being an integral part of the policy framing various rights have been bestowed upon the people of India, known as the Fundamental Rights which are enshrined in Part III of the Constitution of India. These rights are not absolute and are thus can be reasonably restricted by the Government. Also, the Directive Principles of State Policy lays down guidelines for lawmaking bodies and policies to be framed keeping in mind the DPSP's. Various institutions of the Government namely the Parliament, President, Legislature and the Judiciary etc. get their powers from the Constitution of India and are bound to follow it. Supreme Court of India is the guardian of the Constitution and hence functions as the supreme body of law and its task of delivering justice to the masses.

Thus the Law Day is celebrated every year to commemorate the importance of Constitution in India and its effect on the masses. This year on 26th November 2017 our Prime Minister Narendra Modi addressed the gathering stating that the three wings of the government the legislature, the judiciary and the executive are a part of the same unit and should work in unity and help each and the idea of judicial activism was widely spread over to the gathering. Also, he said that the three wings should brainstorm on how to move forward in a changing scenario and how to govern, adjudicate and legislate the today's societal demands. Also, he said that the pillars of the government structure should understand each other's problem should work towards making a new India. Also, he emphasized on the topic of "Eyes of Justice" to deliver justice in a particular time frame and also competitiveness amongst the courts. But it was observed that the views of the Law Minister and Chief Justice of India. Mr. Ravishankar Prasad, the Law Minister of India was of the view that even though PIL(Public Interest Litigation) is helpful in bringing justice to the underprivileged, it should not replace the government and should not be treated as an available option to the ruling government. Whereas Justice Deepak Mishra quoted that fundamental rights of the citizens of the country should be the top priority of the Government to safeguard.
